Container City®️ – Terms and Conditions of Sale

These Terms and Conditions (“Agreement”) apply to all sales of shipping containers (“Containers”) by Container City(“Seller”) to any purchaser (“Customer”). By purchasing a Container from Seller, Customer agrees to the following terms:

1. All Sales Final

All sales are final. No refunds, returns, or exchanges will be accepted under any circumstances.

2. Warranties

• Used Shipping Containers: Sold with a 5-year limited leak warranty.

• One-Trip and New Containers: Sold with a 10-year limited leak warranty.

• This warranty is limited to watertight integrity only. Cosmetic conditions, rust, dents, flooring wear, and other non-leak-related issues are not covered. Warranty is void if the Container has been altered, modified, or moved by parties other than Seller or its authorized agents.

3. Delivery Terms

• Delivery dates are estimates only and are subject to change due to weather, road conditions, availability, or other factors beyond Seller’s control.

• One-trip Containers may have varying manufacturing dates. Seller does not guarantee a specific year of manufacture unless stated in writing at the time of sale.

4. Limitation of Liability & Indemnity

By purchasing a container from Container City®, the customer acknowledges and agrees to the following:

1. Limitation of Liability
   Container City® shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the purchase, use, transportation, storage, or resale of the container. All containers are sold “as-is”, unless otherwise stated in writing.

2. Indemnification
   The customer agrees to indemnify, defend, and hold harmless Container City®, its owners, employees, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees and court costs) arising out of or relating to:

   • The customer’s use or misuse of the container;

   • Any breach of this agreement by the customer;

   • Any third-party claims related to the container once possession has been transferred to the customer.

3. Legal Fees
   In the event of any dispute, claim, or legal action arising out of or relating to this agreement or the sale of any container, the customer agrees to be responsible for all legal fees and costs incurred by Container City® in enforcing its rights or defending itself against such claims.

5. Jurisdiction

Any legal action arising out of or relating to the purchase or use of the Container must be brought exclusively in the state or federal courts located in the State of Montana. Customer consents to the exclusive jurisdiction and venue of such courts.

6. Taxes

Customer is solely responsible for paying all applicable state and local use taxes, sales taxes, and any other taxes or fees imposed in connection with the purchase or delivery of the Container. 

7. Container City – Storage Policy & Depot Hours

Customers are required to pick up their containers within 30 days of availability.
After the 30-day period, a daily storage fee of $25 will be applied.

Depot Hours of Operation:
Monday to Friday – 8:00 AM to 4:00 PM
(Closed on weekends and public holidays)
